FAQ - Form 8822

What is the purpose of Form 8822?
Form 8822 helps you understand the information you will need to complete Form 8825, or if you are a foreign person who wants to file a Form 8822, how to complete it, how to obtain some information about your return to obtain a U.S. tax refund, and how to report the information. It is intended only for use by persons who have legal responsibilities to report certain federal income to the IRS as well as certain foreign income to the tax authorities of the country from which you have received the income. By not filing a return with this form, you could potentially be subject to penalties or an audit for failure to file. You should also note that failure to file a Form 8822 would not necessarily mean that you will owe any tax withheld from any payment. For more information on the filing requirements for Form 8822, refer to Notice 2015-77. You may be required to file Form 8822 to report taxable income from U.S. sources. For more information about reporting, see Guide T409, U.S. Tax Guide for Certain Aliens Abroad. What information should you provide in Form 8822? In preparing your Form 8822, you may have to report certain information that is required under the Internal Revenue Code. The information listed below is based on tax laws and regulations, and is subject to different conditions. You must also file Form 8825 to report gross income from sources within your tax home, except to the extent they are exempt from U.S. tax under a tax treaty with a country outside the U.S. You should not include Form 8822 as part of your foreign income reported on Form 8825. The information you report in the following boxes and columns must be complete. If you are required to report withholding under Part J of the Internal Revenue Code, you must list any United States withholding agent who is required to give you your federal income tax, social security, Medicare, or FICA tax. Note that these agents must be able to give you this information at the time of filing the return. If you cannot give him or her this information directly, you can write them a letter certifying the withholding agent. You should enter it on the cover page of your return as “Information for withholders.” Box 1. Type of income, type or types of business.

Can I create my own Form 8822?
Yes. All you need to do is call. Once you answer the question “How many (years, months, days, hours, minutes, seconds, tenths, four hundredths, etc.)”, it will ask you to specify the form you want me to use. Once you hit “Save” it takes you to a screen where you can enter your information. It will then tell you the appropriate form number to fill out to receive your Form 8221/8221 N. (As of 08/03/18 it will also tell you that the “S/N” format is not applicable.) There are two types of Form 8221/8221 N. S (Single) and N (New). The number of characters that you enter for the S (Single) Form 8822 will count toward your four-page limit as one of the four standard Form Forms. The number of characters that you enter for the N (New) Form 8822 will count toward your one-page limit. Therefore, when you call, you may not have four pages to enter information for your Form 8822 (N) and you may only speak for about 5 seconds! Can I change my address after calling ? Yes. If you have changed your address after calling, please contact to amend the new address on your registration. What if my application is rejected for any reason? At least 5 business days before an application is rejected, you will have an opportunity to complete the application procedure. A confirmation e-mail will be sent to you and then the application will be rejected. You are not required to re-submit your registration by this time if you wish to register again after the rejection. Applications are not automatically re-approved after rejection. If you have submitted the application again following rejection, in order to be placed on the waiting list for a future appointment session, you will be required to pay the 3.00 fee again. I received a verification e-mail that my application has been processed. What does it mean? A verification e-mail is a message that your registration has been placed into a waiting list.
What should I do with Form 8822 when it’s complete?
Fill out Form 8822 only once and keep it with your tax return information. It is also helpful to keep the Form 8822-T available throughout the year, for example, at your accountant’s office when you need it. Note that if you have to file a Form 8822-T within the year you must file the actual tax return as scheduled. If you do not file within the specified filing deadline, the IRS may assess a late filing penalty and interest. If I need to file a refund form at the end of 2010, when should I file? If you have filed a tax return as scheduled or have received a Form 8822-T, but you do not plan to file your 2010 tax return with the IRS by the due date, it is important that you file your 2010 tax return within the due date. Because you will need to file a Form 1040X and a T4 slip with your return to the next few months, do this now so that you can submit your tax return promptly. If you do not have a scheduled 2011 tax return because you need to submit an extension (for example, you missed filing your tax return for 2010 and expect to file in 2011), you should do so as soon as you have filed your 2010 tax return. If I do not file a tax return when should I file? If you have submitted a taxpayer information return and still have unpaid taxes and/or penalties to recover, you should file a tax return or return information statement as scheduled. The penalty or interest does not begin to accrue until the return is filed. If some of my income for 2008 was exempt in 2008, what is my refund amount? Generally, the refund due for the tax year you filed or became required to file your return will be: the excess of the allowable credit over the tax liability owing for the taxpayer category in which that amount was received; or The excess, on the taxpayer's income tax return, of the amount of federal income tax withheld on the tax return, over the amount of tax the taxpayer was required to pay. (For more information on the Federal Tax Withholding Rates, see Notice 2008-45, Q&A 11.2-2, available on the IRS website and the Notice 2010-45, Q&A 11.5, available on the CRS website.

How many people fill out Form 8822 each year?
As a private business, only about 50 people fill out Form 8822 each year (depending on the company size). A corporation, on the other hand, is a business. Is it easy to fill out Form 8822? Yes. Form 8822 is a simple form that requires a minimum of two people (two people are always needed to complete an IRS form, so it is definitely worth having a second person help fill it out). Are you required to report the annual amount your company made? No. Only the gross amount of all taxable dividends and interest that are paid or accrued (taxed or untamed) is reported on Form 8822. If you report the total amount of cash, stock, or other property you own, like a 401(k) account, you are required to report the income on Schedule C (and can see some information about your 401(k) account on Schedule 4). Why should I report the gross amount of my income? You are required to report your income on Form 1040. Schedule C tells you your taxable income. How do I calculate my gross income? To figure out your gross income on Schedule C, look at the sum of your wages, tips, and self-employment income (such as your Social Security, Medicare, and Railroad Retirement) divided by your total compensation. There is an automatic adjustment to that number every time you file an income tax return (for tax years before 2018, you'll have it deducted from your check). You may need to make adjustments for changes in your employment (for example, if you change job or get fired). That adjustment is included in the gross amount of your income for that tax year. How do I calculate my adjusted gross income (AGI)? Use your AGI from Form 1040 to figure your AGI under the modified adjusted gross income (MAGI) method.
Is there a due date for Form 8822?
What do the dates “for reporting on Form 8821” and “for filing Form 4868” mean? When you file your tax return for a subsequent taxable year, you should file a complete, correct, and timely Form 8822 if the return contains a change in address, social security number, or other item that would cause you to be classified as a new taxpayer. Please see the chart below for the due dates for Form 8822. If you file prior to 2018 Tax Day, you will need to file your return after the 10th day of the 9th month following the close of the prior year's tax year (December 31). If you file after 2018 Tax Day, you are required to file a complete, correct, and timely Form 8821. What should I do if I find that a report that I filed on a previous year was incorrect and must be re-filed? If you believe that an incorrect return filed by any person on an earlier report has been corrected, consult with the appropriate IRS office by telephone before filing your amended return, by email at and by mail at: Internal Revenue Service Attn: Corrective Action Request P.O. Box 132093 Arlington, VA 22 What should I do if my employer does not file a Form 4868 or Form 8821? If your employer does not file required IRS forms, and you were not responsible for the employer not filing your reported wages, it is likely either that the employer failed to properly pay all federal income taxes of you on time, or that you did not report your wages correctly in the first place. When you file your annual income tax return on a later date than the 15th of the month or the due date that you provided the employer, make sure you file an amended return that includes your correct, up-to-date wages. See the chart below for filing dates for Form 4868, Form 8821, and Form 8949. I found a mistake in my 2015 calendar year Form W-2. How can I correct it? If you find a mistake in a Form W-2 reported to you by a third party, and you do not have control over any employee or pension plan, the IRS will not have jurisdiction over you.
