What is the purpose of Form 8822?
Form 8822 helps you understand the information you will need to complete Form 8825, or if you are a foreign person who wants to file a Form 8822, how to complete it, how to obtain some information about your return to obtain a U.S. tax refund, and how to report the information. It is intended only for use by persons who have legal responsibilities to report certain federal income to the IRS as well as certain foreign income to the tax authorities of the country from which you have received the income. By not filing a return with this form, you could potentially be subject to penalties or an audit for failure to file. You should also note that failure to file a Form 8822 would not necessarily mean that you will owe any tax withheld from any payment. For more information on the filing requirements for Form 8822, refer to Notice 2015-77. You may be required to file Form 8822 to report taxable income from U.S. sources. For more information about reporting, see Guide T409, U.S. Tax Guide for Certain Aliens Abroad. What information should you provide in Form 8822? In preparing your Form 8822, you may have to report certain information that is required under the Internal Revenue Code. The information listed below is based on tax laws and regulations, and is subject to different conditions. For more information on certain U.S. taxes including tax withholding you are required to pay, see U.S. tax treaty information. You must also file Form 8825 to report gross income from sources within your tax home, except to the extent they are exempt from U.S. tax under a tax treaty with a country outside the U.S. You should not include Form 8822 as part of your foreign income reported on Form 8825. The information you report in the following boxes and columns must be complete. If you are required to report withholding under Part J of the Internal Revenue Code, you must list any United States withholding agent who is required to give you your federal income tax, social security, Medicare, or FICA tax. Note that these agents must be able to give you this information at the time of filing the return. If you cannot give him or her this information directly, you can write them a letter certifying the withholding agent. Who should complete Form 8822?
You should complete this form if someone is claiming a child in the United States under the U.S. Immigration and Nationality Act (I.N.A.) or another federal law. To complete Form 8822, the individual must provide documentation that is acceptable and satisfactory to the U.S. Social Security Administration (SSA) to establish U.S. citizenship. If the individual is claiming the U.S. or United Nations Convention Relating to the Status of Refugees (UNHCR) as a child to obtain United States citizenship, the SSA must approve the Form 8822 application or Form I-864 to establish U.S. citizenship. You can complete Form 8822 only once. Anyone who submits a replacement for Form 8822 that is not completed and dated correctly loses their right to citizenship. How to complete Form 8903(d) If you want to take advantage of the U.S. government's child tax benefits, take Form 8903(d) to a Social Security Administration (SSA) office. You will submit your original Form 8903(d) (or a copy) along with evidence that shows you (a) applied for or received a change of status for yourself, (b) submitted an online Change of Residence form, or (c) enrolled for self-employment (Form 1040-ES). The SSA will review the evidence, make an initial determination about your U.S. citizenship status based on the information, and notify you whether the SSA will register your children with the Department of Homeland Security (DHS). Yes. All you need to do is call. Once you answer the question “How many (years, months, days, hours, minutes, seconds, tenths, four hundredths, etc.)”, it will ask you to specify the form you want me to use. Once you hit “Save” it takes you to a screen where you can enter your information. It will then tell you the appropriate form number to fill out to receive your Form 8221/8221 N. (As of 08/03/18 it will also tell you that the “S/N” format is not applicable.) There are two types of Form 8221/8221 N. S (Single) and N (New). The number of characters that you enter for the S (Single) Form 8822 will count toward your four-page limit as one of the four standard Form Forms. The number of characters that you enter for the N (New) Form 8822 will count toward your one-page limit. Therefore, when you call, you may not have four pages to enter information for your Form 8822 (N) and you may only speak for about 5 seconds! Can I change my address after calling ? Yes. In some cases where you are unable to get to your bank and are unable to take a cashier's check, you may need a Form T1040A, Employment Insurance Certificate of Employment, in order to prove that you received the EI payment.
